scope of application

The following terms and conditions apply to all sales, deliveries and services from Apfelbaumdesign.ch. By executing an order from our range, these are deemed to have been accepted and accepted. The buyer's general terms and conditions of purchase are hereby contradicted. If for any reason a point of the general terms and conditions should be invalid, the validity of the remaining points remains unaffected. Changes and additions to these terms and conditions must be in writing and are only effective if Apfelbaumdesign.ch agrees to them in writing with the customer.

offers and prices
All offers in the online shop represent a non-binding offer to the customer. By executing an order, the customer makes a binding offer to conclude a purchase contract. This only comes about through the delivery of the ordered goods. The listed prices are accepted prices when placing the order. Subsequent price changes and deviations during the execution of the order, which occur after the order has been completed, cannot be taken into account. The information on the offers such as size, dimensions and weights are only intended as guidelines and are therefore not guarantees of properties. Apfelbaumdesign.ch reserves the right to cancel orders that have already been placed at any time and to immediately reimburse the customer for the advance payments already made. There is therefore no obligation to deliver the goods at any time.

payment, delivery and shipping
Payment is made using the payment methods offered (advance payment, invoice, credit card, etc.). Collection of the goods and payment by cash on name are not offered. The following points must be observed for the individual payment methods:

• Invoice: Purchase via invoice is only possible for private customers. The payment period is 30 days.

• Payment in advance: Always state the order number as a reference/purpose of payment when paying. The invoice amount is to be paid in advance within 14 days of placing the order. If payment is not made within this period, Apfelbaumdesign.ch reserves the right to cancel the order.

• E-finance and PostFinance: Only possible for PostFinance customers with a PostFinance card.

• Credit card payment: Only possible with Visa or MasterCard. All other credit cards can be used via the PayPal payment method. No PayPal customer account is required for this.

• PayPal: PayPal can also be used to pay with all major credit cards. A PayPal customer account is not necessary for this.

• Payment at the post office counter: No payment slips will be sent. You must fill out the payment slip yourself.

• Payment by envelope: The customer bears the shipping risk of the cash payment. If the envelope is lost or stolen on the way to us, we assume no liability. Therefore always send as registered mail or package.

• Twint: Simple payment via Twint app.

The items from Apfelbaumdesign.ch are usually in stock and can be delivered immediately. When ordering several items, Apfelbaumdesign.ch always endeavors to deliver them in full. If an article is exceptionally not available or sold out, it will be sent to the customer immediately after receipt by the supplier. In this case there is no right to cancellation of the order or compensation. The customer therefore agrees to accept partial deliveries at any time. Uninsured shipping without a tracking number is always free for the customer as a standard option. In addition, insured shipping with tracking number (signature – against signature) is offered for an additional charge of 7 CHF. There is no binding indication of delivery times for either type of shipment. In addition, express delivery is offered for a surcharge of CHF 22 with guaranteed delivery on the next day (Monday – Saturday). In the case of uninsured shipping or express delivery, the risk of damage to the goods or loss of the entire shipment during transport passes to the buyer as soon as the shipment has been handed over to Swiss Post. Apfelbaumdesign.ch is not liable for such damages. All orders that are in stock and were not ordered by express will be sent after receipt of payment either by A Mail letter/box (small orders or individual items up to 250 grams and/or up to 5 cm in height) or as an A Mail parcel (larger and heavier Orders over 250 grams and/or 5cm in height) sent to the customer. The A-Post consignments are usually delivered on the next working day (note: parcels are not delivered on Saturdays). A guarantee for delivery on the next working day is excluded for an A-Post delivery. In the case of express delivery, delivery is guaranteed by Swiss Post on the next working day or on Saturday. If there are any delays, please contact our customer service. A delay in the arrival of the goods for whatever reason does not entitle the customer to a deduction from the invoice and is not a basis for a claim for compensation. Liability for delays in agreed forward transactions on the part of the customer is also excluded.

a) Purchase on account with partial payment option (PowerPay)

With the PowerPay monthly invoice, you can easily pay for your online purchase by invoice with an option to pay in installments. As an external payment service provider, MF Group / PowerPay offers the payment method “payment by invoice”. When the purchase contract is concluded, PowerPay takes over the invoice claim and handles the corresponding payment modalities. When purchasing on account, you also accept the terms and conditions PowerPay Terms and Conditions.

Please note that there is an administration fee per invoice and additional fees for partial and late payment according to Conditions from PowerPay.

returns and exchanges

You can return the items you have purchased from us within 30 days of receipt if you do not like them, provided that the goods are complete, unused and undamaged. Dirty, used or damaged goods will not be taken back and will be returned to the sender. The return costs and the shipping risk to our returns department are to be borne by the buyer in any case. Custom-made products and also special orders in larger quantities at the customer's request are excluded from return.

warranty

Our warranty is two months for dealers and traders and 24 months for end customers. The warranty period begins when the goods are shipped to the customer. The customer is obliged to report any defects immediately and to comply with the instructions and procedures for an exchange. In the case of insured shipping, transport damage must be reported in writing to the post office and to us within 24 hours of the next working day. Uninsured shipments are excluded. In the case of uninsured shipping or express mail, no liability is accepted in the event of loss or theft of the shipment during transport or if it is stolen from the letterbox slot. Claims for cancellation of the contract or reduction of the purchase price are excluded if a replacement delivery is possible. The defective goods must be returned by the buyer to our returns department, regardless of size and weight. The cost and shipping risk for the return are to be borne by the buyer. A replacement delivery or exchange under warranty does not generate any new warranty periods. Excluded from the warranty are: blows, bumps, falls, collisions, pressure, heat and sunlight, cold, liquids, dirt, dust, dirt, mud and damage caused by the customer attempting to repair himself. The guarantee expires in the case of interventions that are not carried out by Apfelbaumdesign .ch or without their consent. Insignificant deviations from the guaranteed properties of the goods do not allow for any warranty rights. Warranty claims against Apfelbaumdesign .ch are only available to the direct purchaser and are therefore not assignable.

Limitation of Liability

There is an exclusion of liability for incorrect handling of the items, natural wear and tear or external influences. Further claims by the customer, for whatever legal reason, are excluded. Apfelbaumdesign.ch is not liable for damage that has not occurred to the delivery item itself. If the customer's product is damaged or destroyed as a result of the installation of accessories, liability for such damage is excluded. This also applies to their direct or indirect consequences. In particular, apple tree design is liable. ch not for lost profits or financial losses of the customer.

 

Note on our articles and our product descriptions

We try to present photos, texts and product descriptions for our items as precisely as possible. A right of return for the reason mentioned is therefore excluded. Therefore, all information, product descriptions, colors and photos on our website are non-binding and an exchange is excluded for these reasons.

 

data protection

The data you transmit will be treated as strictly confidential by Apfelbaumdesign.ch . The data will only be passed on to third parties, such as our shipping company, if this is necessary for the one-time order processing. There is no liability for the security of the data during transmission over the Internet or for possible criminal access by third parties to files in the web shop.

retention of title

Our goods remain our property until full payment.
